PART I – GENERAL TERMS OF USE OF THE WEBSITE

1. Purpose

These General Terms of Use define the conditions governing access to and use of the website www.bastidedesplaines.fr, operated by La Bastide des Plaines.

The purpose of the website is, in particular, to present La Bastide des Plaines, its tourist accommodation, facilities, surroundings, and the arrangements for submitting a booking request.

Use of the website implies acceptance of these terms.

2. Information provided on the website

La Bastide des Plaines makes every effort to provide accurate, up-to-date and as detailed as possible information regarding the accommodation, its facilities, services, rates and surroundings.

The photographs and videos displayed on the website are intended to allow visitors to discover the accommodation and the property as accurately as possible.

However, minor differences may exist between the photographs and reality, particularly depending on the season, lighting conditions or circumstances in which the photographs were taken.

The contractual information applicable to a booking is that contained in the rental agreement sent to and accepted by the guest.

3. Website availability

La Bastide des Plaines makes every effort to keep its website accessible under normal conditions.

However, access to the website may be temporarily interrupted, particularly for maintenance, updates, security reasons, technical issues or any circumstances beyond the control of the website operator.

La Bastide des Plaines cannot be held liable for any consequences resulting from the temporary unavailability of the website.

4. Intellectual property

All elements appearing on the website, including but not limited to texts, photographs, videos, images, logos, graphics, illustrations and layout elements, are protected by applicable intellectual property laws.

Unless otherwise stated, these elements are the property of La Bastide des Plaines or are used with the permission of their respective rights holders.

Any reproduction, representation, modification, adaptation, distribution or exploitation, in whole or in part, without prior authorization, is prohibited.

PART II – GENERAL RENTAL TERMS

5. Identification of the rental provider

These General Rental Terms apply to bookings made directly with La Bastide des Plaines, including through the website, by email, telephone or post.

6. Purpose of the rental

La Bastide des Plaines is an independent villa of approximately 42 m², classified as 5-star furnished tourist accommodation, located in Brézilhac, in the Aude department of France.

The accommodation is intended exclusively for short-term tourist rentals.

Stays are available for a minimum of 2 nights and a maximum of 7 nights. Bookings for a single night or for more than 7 nights are not accepted.

Accommodation capacity

The villa has a maximum capacity of two guests.

One baby under the age of two may be accommodated upon prior request. This is provided at no additional charge.

To make the stay easier for parents, a travel cot and a booster seat are provided free of charge.

Children aged two years or over are not permitted in the accommodation, as the maximum capacity is limited to two guests.

Babies staying at the property remain under the constant supervision and responsibility of their accompanying adults, particularly when using the outdoor areas and the swimming pool.

Pets

No pets are permitted at La Bastide des Plaines, regardless of species, size or breed.

This prohibition applies to the entire property, including the villa, outdoor areas, terraces, garden and the area surrounding the swimming pool.

Guests agree not to arrive at La Bastide des Plaines with a pet or bring a pet onto the property during their stay.

If a guest arrives with a pet, access to the property and accommodation may be refused. In this case, the booking will be considered unfulfilled due to the guest's actions, and no refund of amounts already paid will be issued, subject to any mandatory applicable legal provisions.

This rule also applies if a pet is brought onto the property during the stay without the rental provider's prior written consent.

7. Bookings made through a booking platform

These terms apply exclusively to bookings made directly with La Bastide des Plaines.

Bookings made through Airbnb or another booking platform are subject to the contractual terms, rates, payment arrangements and cancellation policies applicable on the relevant platform.

In particular, the cancellation policy applicable to Airbnb bookings remains the policy displayed on Airbnb at the time of booking and is not modified by these terms.

8. Direct booking requests

All booking requests are subject to the availability of the accommodation.

All booking requests must be for a stay of between 2 and 7 consecutive nights.

When the requested dates are available, the rental provider will send the guest a seasonal rental agreement by email or, upon request, by post.

The agreement specifies, in particular:

• the identity of the tenant;

• the dates of the stay;

• the number of occupants;

• the total rental amount;

• the payment terms;

• the cancellation conditions;

• the amount of the security deposit;

• the main terms of the stay.

The guest must return the agreement, dated and signed, together with the deposit cheque provided for in Article 9.

The booking becomes confirmed upon receipt by the rental provider of the signed agreement and the deposit cheque.

9. Booking deposit

The booking deposit is set at 30% of the total cost of the stay.

It is provided in the form of a cheque, enclosed with the signed rental agreement and returned to the rental provider by post.

The deposit cheque is not cashed at the time of booking.

It is retained by the rental provider until the scheduled arrival date.

The cheque may only be cashed if the cancellation conditions set out in Article 10 result in the rental provider retaining the deposit.

If the stay goes ahead as planned, the deposit cheque is returned to the guest on the day of arrival.

10. Cancellation policy – direct bookings

These cancellation terms apply exclusively to bookings made directly with La Bastide des Plaines.

Cancellation 30 days or more before arrival

Any cancellation received 30 days or more before the scheduled arrival date entitles the guest to a full refund of the 30% deposit.

The deposit cheque will not be cashed and will be returned to the guest.

Cancellation less than 30 days before arrival

Any cancellation received less than 30 days before the scheduled arrival date results in the rental provider retaining the 30% deposit.

The deposit cheque may then be cashed.

No additional amount corresponding to the remaining balance of the stay, which has not yet been paid, will be due by the guest as a result of the cancellation.

Failure to arrive

If the guest fails to arrive without prior cancellation, the 30% deposit will be retained by the rental provider.

Early departure

In the event of an early departure after the start of the stay, unused nights will not be refunded, except in exceptional circumstances agreed by the rental provider or where mandatory legal provisions provide otherwise.

All cancellation requests must be sent to the rental provider in writing.

The date on which the request is received shall be deemed authoritative.

11. Changes to the dates of stay

Any request to change the dates of the stay must be submitted to the rental provider in writing.

Any change must comply with the applicable booking duration requirements, namely a minimum of 2 nights and a maximum of 7 nights.

Any change remains subject to the rental provider's approval and the availability of the accommodation.

A significant change to the dates may be considered a cancellation of the original booking followed by a new booking.

12. Payment for the stay upon arrival

On the day of arrival, the 30% deposit cheque is returned to the guest.

The guest then pays the full amount of the stay, representing 100% of the agreed price.

Payment may be made:

• in cash;

• by bank card.

Where applicable, tourist tax is charged in accordance with the regulations in force.

Full payment for the stay must be made before or at the time the keys are handed over.

13. Security deposit

A security deposit of €600 is required from the guest upon arrival.

It must be provided in the form of a cheque for €600.

The security deposit cheque is retained by the rental provider for the duration of the stay.

Provided there is no damage, loss, deterioration or outstanding amount due, the security deposit cheque will be returned to the guest upon departure.

In the event of damage, the rental provider may retain all or part of the security deposit up to the amount of the actual loss suffered.

Where the amount of the loss is less than €600, only the amount corresponding to the actual loss may be retained.

Where the loss exceeds €600, the guest may be required to pay the additional amount corresponding to the actual damage suffered.

14. Presence of the owners on the property

La Bastide des Plaines is an independent villa adjoining the owners' main residence.

The owners live on the property in their private residence, which is separate from the rented accommodation.

The villa has its own independent access and private areas reserved for guests.

The presence of the owners on the property does not affect the independent and private nature of the rented accommodation.

Guests have their own living space and private facilities throughout their stay.

15. Presence of Cannelle and Vanille

Two small Yorkshire dogs, Cannelle and Vanille, live on the property with the owners.

They do not have access to the rented villa or to the private areas reserved for guests.

However, they may occasionally be seen in other outdoor areas of the property.

Guests are informed of their presence before their stay.

Guests are not required to look after, feed or care for them.

16. Property video surveillance system

For the safety and security of persons and property, the premises are equipped with a video surveillance system.

The system includes:

• two cameras located near the gate and property access points;

• two cameras located near the swimming pool and garden.

The cameras are installed in the outdoor areas of the property and are intended to secure access points, buildings and property.

Privacy protection

No cameras are installed inside the rented villa.

The cameras are not intended to monitor the interior of the accommodation or the private lives of guests.

Camera angles are limited to the outdoor areas necessary for the security of the property and must be configured so as to avoid filming guests' private areas beyond what is strictly necessary.

Recording of images

The system records video footage.

The recordings are retained for a maximum period of approximately 7 days and are then automatically deleted, unless a specific event requires their retention to establish facts, preserve evidence or comply with a legal obligation.

Access to the recordings is restricted to persons authorized by the person responsible for the system and only for purposes related to security.

The recordings are not used to monitor guests in their daily activities.

Data subjects may exercise their rights in accordance with the applicable regulations governing personal data protection.

The French data protection authority (CNIL) reminds private individuals that they must respect the privacy of visitors and may only film their own property. Where persons outside the private sphere may be affected, they must be informed of the existence and purpose of the cameras.

17. Occupancy of the accommodation

The accommodation is intended to accommodate the number of guests stated at the time of booking.

The maximum capacity is limited to two guests.

One baby under the age of two may be accommodated under the conditions set out in Article 6.

Children aged two years or over are not permitted.

The number of occupants may not be increased without the prior consent of the rental provider.

The accommodation may not be used to organize parties, evenings, events or gatherings that were not planned at the time of booking.

Subletting the accommodation is prohibited.

The guest agrees to use the premises peacefully and to respect the neighbours.

18. Pets

No pets are permitted at La Bastide des Plaines.

This prohibition is general and applies to all animals, regardless of species, size or breed.

In particular, guests are prohibited from staying with a dog, cat or any other domestic or companion animal.

Under no circumstances may a guest bring an animal into the villa or onto the property, or leave an animal in a vehicle parked on the property during the stay.

Arriving with an animal or bringing an animal onto the property during the stay constitutes a serious breach of these General Rental Terms.

If a guest arrives with an animal, access to the property and accommodation may be refused. No refund of any amounts paid in connection with the booking will be issued as a result of the guest's breach, subject to any mandatory applicable legal provisions.

If an animal is brought onto the property after arrival, the rental provider may terminate the stay under the conditions set out in Article 24.

No refund for the remaining unused nights may then be claimed by the guest, subject to any mandatory applicable legal provisions.

Any additional cleaning, treatment, disinfection, repair or restoration made necessary by the unauthorized presence of an animal may be charged to the guest and, where applicable, deducted from the security deposit.

19. Swimming pool

The swimming pool is reserved exclusively for guests throughout their stay, subject to the opening period and hours communicated at the time of booking.

Use of the swimming pool is subject to compliance with the safety instructions provided to the guest.

The presence of any animal is strictly prohibited anywhere on the property, including around the swimming pool and in the pool itself.

Babies accommodated under the conditions set out in Article 6 remain under the constant supervision and responsibility of their accompanying adults.

The swimming pool is not supervised.

The legally required safety equipment does not under any circumstances exempt users from their duty of supervision.

Access to the swimming pool is reserved for guests included in the booking and may not be used by persons not staying at the property without the prior consent of the rental provider.

20. Condition of the accommodation and facilities

The accommodation is provided to the guest clean, in good condition and with the facilities and equipment described.

The guest must promptly report to the rental provider any defect, damage or malfunction observed upon arrival.

The guest agrees to take proper care of the accommodation, furniture, equipment and facilities made available.

21. Damage and deterioration

The guest is responsible for any damage caused to the accommodation, furniture, equipment or facilities resulting from their actions or those of persons for whom they are responsible.

Damages may be deducted from the security deposit under the conditions set out in Article 13.

Any amounts remaining due beyond the security deposit remain the responsibility of the guest.

22. Arrival and departure

Arrival and departure times are communicated to the guest at the time of booking.

Unless otherwise agreed, arrival takes place by appointment with the rental provider.

The guest is invited to communicate their expected arrival time sufficiently in advance.

The accommodation must be vacated at the agreed departure time.

Any unauthorized late departure may result in an additional charge where it causes inconvenience or additional costs.

23. Liability of the rental provider

La Bastide des Plaines makes every effort to ensure that guests enjoy a stay consistent with the description of the accommodation.

However, the rental provider cannot be held liable for events beyond their control, force majeure or consequences resulting from the guest's wrongful conduct.

In particular, the rental provider cannot be held responsible for the loss, theft or deterioration of personal belongings left unattended in the accommodation or elsewhere on the property.

24. Guest conduct

The guest agrees to behave respectfully towards the property, the owners, the neighbours and the environment.

Failure to comply with the prohibition on bringing an animal onto the property constitutes a serious breach of these General Rental Terms.

Any violent, dangerous, fraudulent or seriously inappropriate behaviour in breach of these terms may result in the termination of the stay.

Where the stay is terminated as a result of a breach by the guest, no refund for the remaining unused portion of the stay may be claimed, subject to any mandatory applicable legal provisions.

25. Force majeure

Neither party may be held liable for failure to perform an obligation resulting from an event of force majeure within the meaning of French law.

26. No right of withdrawal

In accordance with the provisions applicable to accommodation services provided on a specific date or during a specified period, the statutory right of withdrawal applicable to certain distance contracts does not apply to the booking of tourist accommodation for a specified period.

The cancellation conditions set out in these terms therefore remain applicable.

27. Complaints

Any complaint concerning the stay must be submitted to the rental provider as soon as possible in order to allow, where possible, an amicable resolution.

28. Consumer mediation

Where the provisions relating to consumer mediation apply, the consumer guest must first submit a written complaint to La Bastide des Plaines in order to seek an amicable resolution.

If this process is unsuccessful, the consumer may use, free of charge, the consumer mediator to which La Bastide des Plaines has subscribed.

The contact details of the relevant mediator will be provided in accordance with the applicable legal requirements.

29. Personal data

Personal data collected in connection with enquiries, bookings and stays are processed in accordance with our Privacy Policy.

Information relating to cookies and other tracking technologies is provided in our Cookie Policy.

The processing of images recorded by the video surveillance system is also subject to the applicable rules governing the protection of personal data.

30. Applicable law

These terms are governed by French law.

In the event of a dispute, the parties will first endeavour to seek an amicable resolution.

Failing this, the competent courts shall be those designated in accordance with the jurisdiction rules provided for by applicable French law.

31. Amendment of these terms

La Bastide des Plaines reserves the right to amend these terms in order to take account of changes in its business or in applicable regulations.

The terms applicable to a booking are those accepted by the guest at the time the rental agreement is concluded.
